When undergoing the worker classification process, Experts will be asked to provide at least two business documents from the following list as evidence of their business structure.
Please see below for the types of documents that will be accepted and their purpose for supporting an Expert’s status as an Independent Contractor.
Type of Document |
Purpose and Examples of the Document |
Proof of active LLC, S-Corp, or Partnership |
This document proves that you have a legal business entity. The Secretary of State website for your state is typically the best place to obtain these documents. |
Fictitious Business Name or DBA (Doing Business As) Certificate |
This document indicates that you are working as a legal business entity and that the legal business entity may be popularly known as and/or marketed under another name. |
Form 1099 (or local equivalent) |
This document proves that you have been paid as an independent business by other clients; proves that you are not financially reliant on Catalant client(s). |
Other Documentation of Business Income |
This proves that you are paid through your legal business entity. Example: Redacted bank statements showing your business name on the account, redacted tax returns, or redacted client invoices. |
Marketing Materials |
This proves that you market yourself as a business. Example: Website, LinkedIn profile (showing your business or other work platform profile), website URL, or a screenshot from any other online forum where you advertise your services. Other proof that you work and market yourself as a business entity. |
Proof of Investment |
This proves that you are investing in your business. Example: Receipts or monthly statements showing business investment, office space or co-working space lease, or other proof that you have invested money in your business. |
Certificate of Insurance Covering Business Activities |
This proves that you have insurance coverage for your business activities. Proof of active coverage for general liability, E&O, worker's compensation, or other business insurance |
Providing two or more documents from the list above may not indicate Independent Contractor status.
Catalant’s Compliance team reviews all of the project factors and details below. A determination of Independent Contractor status is calculated using a weighted review of the factors below:
- Project details: This could include project duration, rate, and type of work to be completed.
- Expert details: This could include location and independent business verification.
- Hiring Manager responses to a provided questionnaire.
